What to Look for In a Divorce Attorney

 

>> Experience doing Divorce Trials.  Do not get stuck with a learning associate in a law firm.  Even if you hope for a settlement, your attorney must be prepared to go to trial with the knowledge of what’s to come, the ability to think on one’s feet, and a good relationship with the court.  If your attorney is not a good trial lawyer ready to go to trial if needed, then chances are you will not get a very good settlement.

>> Experience doing Divorce Mediations.  The importance of good representation during mediations and other settlement venues is often overlooked, even by attorneys.  A good divorce attorney has many years of settlement experience and can help you get a settlement that you are comfortable with. 

>> Good Reviews.  Search for the attorney’s name and reviews. Make sure to use Google as that is where most reviews will be shown to you.

>> Clear Communication.  This is very important since you need to understand what is going on during every aspect oof your case.  You can get a sense of how clearly lawyers communicate when you call to discuss retaining them. 

>> Open & Honest.  Again, you can get a sense of this when talking with the divorce attorney.  You should never feel like information is being withheld or falsely provided.  Your attorney should also not sound like a used car salesperson.

Considerations

“Divorce” has an ugly sound to it for most people.  If you are considering it, you have not reached this point either lightly or easily.  I know.  Although all cases are unique, they also have many similarities.  All of my clients have reached the “divorce” stage only after deep and heavy thoughts and feelings.  Whether your marriage was very short or long, or somewhere in between, you are facing the end of a relationship which was born of commitment, and resulted in the sharing of children, assets, debts, and lost years of your life, whether some or all of these.

So, what are you going to do?  What should you do?  Is the marriage worth saving? Even if the marriage is not worth saving, is it worth trying to put the divorce on hold for a while to give you time to come out “better” when the divorce is filed later?  Is there anything you should do before filing for a divorce with the kids, money or assets?  If the divorce has already been filed, is there anything you can do right now to better position yourself for what is to come?  And what about your state of mind?  A divorce isn’t over in a day.  It sometimes seems like an eternity.

A divorce is one of the most impactful events in your life.  This is why you need an attorney.  You need to know the rules of evidence, the rules and law of Colorado divorce including parenting time, spousal support, child support, and asset and debt distribution (including rules for dividing retirement), case management procedure, and proper and good techniques for direct and cross examination along with opening statements and closing arguments.  Even if you know all of the above, it is extremely awkward to call yourself as a witness.  Asking yourself questions in court that you then answer is a circus of sorts, leaving you to talk in the narrative. But you can’t have notes with you, so it will either come off as discombobulated, memorized, or you will forget things.  In any event, it will not be very smooth and will certainly be outside “the flow”.
