A separation agreement is a contract between the spouses, which if approved by the Court, becomes a court order and establishes enforceable rights and obligations concerning the parties. This agreement allows the parties, rather than the Court to determine the parties' fate. These rights and obligations may continue long after the divorce has become final, so should be very carefully negotiated and drafted to take into account the years to come.
