Spousal Maintenance?
Colorado Alimony and Maintenance Lawyer
Spousal maintenance is what used to be called "alimony" in Colorado. It is court-ordered financial support from one spouse to the other during and/or after the divorce process. It is specifically provided for in C.R.S. 14-10-114.
Attorney Jeff Alter will represent you thoroughly whether you are seeking maintenance or hoping to avoid paying it. Jeff is well aware of the factors that courts consider in maintenance issues such as:
- Financial resources of the party seeking maintenance;
- Time necessary to get sufficient education or training to find appropriate employment;
- Future earning capacity of the party seeking maintenance;
- Standard of living established during the marriage;
- Duration of the marriage;
- Age, physical and emotional condition of spouse seeking maintenance;
- Ability of payor spouse to meet his or her own needs while paying maintenance.
Although the above respective factors must be considered in awarding maintenance, the court also has discretion to determine what it finds to be an equitable or just award. It is not out of the question for different judges to come up with different results based upon the same facts. This is why you need an attorney who will stand up for you and represent your rights.
Modification of Maintenance - Jeff can also assist you with
getting your maintenance modified. Existing maintenance orders will be
evaluated on the basis of whether a substantial and continuing change of
circumstances has made the existing order unfair. Jeff will help you put
together an evidentiary presentation to get you what you deserve.
